A road accident throws everyone off balance. The steps you take in the first hour protect both your safety and any claim or case that comes later.
Stop and help
The law requires drivers involved in an accident to stop. Driving off can turn a civil matter into a criminal one. Check whether anyone is hurt, and if the vehicles are creating a hazard and it is safe to move them, do so.
Get an official record
Call the police so there is a formal report. That report often becomes the single most useful document later, whether you are the one making a claim or the one being blamed.
Collect what you can, while it is fresh
Before positions harden and memories fade, gather the basics:
- Photos of the vehicles, plates, the road, and any injuries
- The other driver license, plate number, and insurance details
- Names and contact numbers of anyone who saw what happened
Insurance and admissions
Tell your insurer promptly and stick to the facts. Resist the urge to apologize or admit fault at the scene. Fault is a legal conclusion for the authorities, and if needed the courts, to reach. It is not something to concede on the roadside.
When to call a lawyer
If someone was injured or killed, or there is a real dispute over who was at fault, speak to a lawyer early. Good advice at the start protects your rights no matter which side of the claim you end up on.
